Introduction

This website, including any subdomains, and any other websites through which its services are made available, such as our mobile, tablet, and other smart device applications, and application program interfaces, (collectively referred to as “Happy Homez”) are owned, hosted, and operated by Ramdee Solutions (hereinafter referred to as R.S.). R.S. is a company incorporated in India under the Companies Act, 1956, and its registered office is located at Ground Floor, GF-12A, 94, Meghdoot, Nehru Place, New Delhi - 110 020.

These terms and conditions, privacy policy, and community guidelines regulate the use of these services and constitute a legally binding agreement between Happy Homez and the User (the “Agreement”).

Happy Homez and any other linked websites provide online information and communications services, subject to your compliance with the terms and conditions outlined below.

R.S. may amend or modify these terms and conditions at any time, and such modifications will be effective immediately upon posting them on Happy Homez. You may periodically review the modified terms to stay informed about any changes and your continued access or use of Happy Homez will be deemed conclusive proof of your acceptance of these terms and conditions, as amended from time to time. R.S. may also suspend the operation of Happy Homez for support, technical upgrades, maintenance work, content updates, or any other reason.

If you use Happy Homez in a manner inconsistent with these terms and conditions, R.S. may terminate your access, block your future access, or seek additional relief as deemed appropriate based on the circumstances of your misuse.

Definitions:
The term “Subscriber/User” encompasses any individual or legal entity that has subscribed to the Services of Happy Homez, whether on a paid or free basis. Access to Happy Homez is restricted to users who provide a username and password, which can be allocated by Happy Homez, chosen by the subscriber, or agreed upon by both parties. It is crucial to emphasize that only authorized users have the right to access the services offered by Happy Homez.

The term “Browser/Visitor” refers to anyone who uses any of the services provided by Happy Homez without creating an account. They can access non-restricted portions of the platform.

The term “Advertiser” includes subscribers or users who upload or relay content using the services.

The use and access to Happy Homez are subject to these terms and conditions and community guidelines. For the purposes of this agreement, any individual who lacks a legal or contractual right to access the services but does so will be considered an “unauthorized user.” Unauthorized users will still be subject to the terms and conditions regulating the usage of Happy Homez, particularly regarding respecting the intellectual property rights of the R.S. and adhering to the terms and conditions mentioned below.

The terms “User” and “Customer” encompass both subscribers/advertisers and browsers/visitors.
The terms ‘Service’ or ‘Services’ encompass the interactive online information service provided by Happy Homez on the internet. This service allows users to access information stored in Happy Homez’ database. Additionally, it includes search tools that enable users to search through the hosted databases and information using various search options that align with their search criteria. Furthermore, the term ‘Service’ does not extend to Happy Homez acting as an agent for any User or Customer. Instead, it functions as a medium for information exchange.

The term ‘RERDA’ refers to the Real Estate (Regulation and Development) Act, 2016 (http://mhupa.gov.in/User_Panel/UserView.aspx?TypeID=1535), as amended, read in conjunction with any rules or regulations that may be formulated thereunder.

Submission and administration of listings and advertisements are included under the term ‘Service’.
User agrees not to submit any property descriptions, photographs, financial, contact, or other information from each property’s data to Happy Homez unless the User has acquired and received all necessary rights and authorizations from the property owner or the power-of-attorney holder, including from the photographer and/or copyright owner of any photographs, to publish and advertise the property on the User’s website or Happy Homez. Similarly, Happy Homez does not own any rights to any banners hosted on its website by its customers, which are strictly for selling space. Happy Homez has not verified the authenticity or compliance requirements of these images, banners, or listings, as may have been required by law at the time. Some listings may contain third-party audio/video content (“AV Content”) for general informational purposes only and does not constitute a recommendation, solicitation, or intention to influence any purchase or decision. Happy Homez and the AV content providers make no guarantees about the accuracy or completeness of the content.

The User agrees to use any content or information provided to R.S./Happy Homez for promotional, marketing, and publicity purposes without compensation. When you provide us with voice samples or voice recordings to generate voiceovers for video listings, you grant us a royalty-free, irrevocable, worldwide, sublicensable, and transferable right and license to use, modify, and further develop the voice samples and recordings in a manner that Happy Homez deems appropriate. If a User is covered under the RERDA, they must obtain all the necessary approvals, licenses, and permits from the competent authorities regarding the project, land, apartment, or plot in the listing, following the due process of law. Further, the User shall adhere to all applicable Laws regarding the Project/Land/Apartment/Plot listed. They must disclose all relevant information as required by LMA and in relation to their registrations under RERDA. This includes the current status and nature of the property, as well as whether it is free from any encumbrances.

The User must also disclose all material factual information about the advertised property, including its accurate dimensions. They must also provide information about their registrations under RERDA and any other property submissions, including the current status and nature of each property. Additionally, they must disclose whether each property is free from any encumbrances.

The User may be required to provide a brief background of the property, including its title, ownership, and possession. R.S. may also request supporting documents to verify the User’s claims about the property’s status. The User may be required to swear an affidavit stating the authenticity of the information provided.

R.S. may, at its sole discretion, search for and remove properties that are alleged to have been submitted in violation of this provision. They may also require additional evidence of compliance from Users who are alleged to have submitted properties or other information in violation of these terms and conditions.

In its sole discretion, R.S. may terminate the accounts of and refuse service to any User who repeatedly or intentionally violates these terms and conditions.

The User agrees to allow the Property listing, or any part of it, to be searched, displayed, accessed, downloaded, copied, and otherwise referenced by users of the User’s website or the Happy Homez website. R.S. will have sole authority to determine how properties will be searchable, displayed, accessed, downloaded, copied, and otherwise used on Happy Homez. They also have the right to modify property listings as per their rights under these terms and conditions.

In addition to the terms mentioned above, the User agrees to:

(a) Represent and warrant that all properties and associated information provided by the User will be accurate.
(b) Not allow the posting of a property on Happy Homez under a name other than the name of a real estate agent who has been duly authorized and engaged by the property owner in this regard.

R.S. will organize property information into defined sections of Happy Homez or create mirror or parallel sites. They reserve the right, consistent with reasonable commercial practices, to remove all or any part of the properties posted on the User’s website or Happy Homez without notice. R.S. does not accept responsibility for checking or verifying the accuracy of reports or data files submitted by the User. While R.S. will take reasonable efforts for data backup and business resumption, the User will be solely responsible for retaining backup copies of all information, photographs, and other materials provided or submitted to Happy Homez.

Users purchasing or renting properties through Happy Homez must verify the details of the property, including its right, title, ownership, lien, and other relevant information on their own. The ‘verified’ tag visible on properties on Happy Homez simply indicates that the property has been advertised in the manner it has been listed. It does not constitute verification of any documentation, ownership details, area, or pricing information of the property.
We use proprietary and third-party AI tools to identify and address harmful content on our platform. These tools are designed to make reasonable efforts to detect violations of our platform terms and applicable laws, including harmful behaviors like speech that violates our platform rules. Automated moderation can operate autonomously or with human oversight, depending on the complexity of the content and our internal guidelines. Based on the results of technological moderation, content may be approved, rejected, or escalated to a second level of review by human moderators. These tools rely on third-party services to provide the detection and moderation capabilities.

Our automated tools are part of a multi-layered moderation process. Please note that users have the right to raise grievances or appeal moderation decisions in accordance with our platform terms [ Grievences ] and such feedback will be reviewed within established timelines, including by human moderators when necessary.

These tools are part of our ongoing efforts to enhance moderation capabilities and ensure compliance with legal and platform standards. While we strive for accuracy and fairness, no system is flawless. The measures are implemented on an “as is” basis, and we will continue to refine them in collaboration with external service providers to better safeguard our community.

Payment Terms
Payments for the services offered by Happy Homez are made on a 100% advance basis. Once a subscriber subscribes to a service, the payment is non-refundable, and the amount paid is appropriated. Refunds, if any, are at the sole discretion of Ramdee Solutions. R.S. does not guarantee the accuracy or timeliness of refunds reaching the user’s card or bank account. The user acknowledges and agrees that R.S./Happy Homez.com, at its sole discretion and without prejudice to other rights and remedies it may have under applicable laws, may set off the amount paid or payable by a subscriber against any amount payable by the user to R.S. under any other agreement or commercial relationship for other products or services. Ramdee Solutions. provides no guarantees of server uptime or applications working properly. All operations are on a best-effort basis, and liability is limited to refunds only. Ramdee Solutions. undertakes no liability for free services. Ramdee Solutions. reserves the right to amend, alter, or change all or any disclaimers or terms of agreements at any time without prior notice. All terms or disclaimers, whether specifically mentioned or not, shall be deemed to be included if any reference is made to them.

Ramdee Solutions takes utmost care to ensure that all or any data or information related to electronic money transfers does not fall into the wrong hands. To complete online transactions involving payments, a user is directed to a Payment Gateway. Ramdee Solutions. does not store or retain credit card data. Since the transaction occurs on a third-party network not controlled by Ramdee Solutions, once a credit card transaction is completed, the payment information is not accessible to anyone at Ramdee Solutions after the online transaction at the Payment Gateway. This ensures the highest level of security.
Ramdee Solutions (R.S.) shall not be held liable for any losses or damages resulting from any inadvertent or intentional disclosure of user account information, as well as information related to online credit card, debit card, and verification process details. R.S. also reserves the right to make errors, omissions, or inaccuracies in any information disclosed and used, regardless of whether it is in accordance with a legal process or otherwise.

Regarding refunds in failed transactions, R.S.’s payment reconciliation team operates on a 24/7 basis, but they cannot guarantee the accuracy or timeliness of refunds reaching subscribers’ cards or bank accounts. This is due to the involvement of multiple organizations in online transaction processing, the current limitations of Internet infrastructure, and the varying working hours and holidays of financial institutions. Refunds for incorrect or objectionable content posted on the site will be at the discretion of Happy Homez.

If you use Happy Homez in a manner that violates these terms and conditions, R.S. may terminate your access, block your future access, or seek other appropriate relief based on the circumstances of your misuse.

In the context of CPL marketing campaigns, R.S. will strive to deliver the agreed-upon number of leads at the agreed-upon cost per lead. However, R.S. retains the sole discretion to decide and deploy the advertising channel or product to generate leads. Additionally, R.S. reserves the right to terminate any campaign at its sole discretion, either upon completing its obligation to deliver leads or upon non-receipt of the stipulated amount under the agreed terms.
R.S. neither guarantees nor participates in any potential conversion of delivered leads or any related transactions. As an intermediary under the IT Act 2000, R.S. is responsible for providing contact details of users who have consented to be contacted about R.S.’s advertised properties, projects, or similar properties.

Any advance or amount received against an invoice is non-refundable. The customer agrees to strictly adhere to applicable data privacy laws regarding the leads delivered by R.S..

R.S. shall not be liable for any loss, direct or indirect, under any circumstances.

If the same lead is generated for the same project within 30 days of the first unique lead generation date, R.S. will consider the recurring lead(s) as duplicates and not charge the duplicate count. In all other scenarios, the lead will be considered unique.

The customer is responsible for protecting the personal data contained in all leads, as per applicable law, and understands that the limited consent obtained by R.S. is for the purpose of enabling it to share the lead with the customer.

While submitting video content for listings or advertisements, the user agrees to comply with the following community guidelines:

•⁠  ⁠The video should be original and free from any copyright issues.
•⁠  ⁠The video should not contain any personally identifiable information of the user or agency.
•⁠  ⁠The video content should not be obscene, inappropriate, or offensive.
•⁠  ⁠The video content should not contain language that is detrimental to any community or segment.

Videos shared by the user will undergo multiple stages of screening, both human and technology-driven, before being made live on the platform. In case of violations of the community guidelines, the video content will be promptly removed from the listing.

Additionally, the video screening process will be initiated in the following cases:

•⁠  ⁠If the user reports the video to the toll-free number or email ID provided.
Infringement claim by agent/user:

If an agent or user makes an infringement claim, the video will be removed from the platform. However, the final decision on video screening and removal always lies with the platform.

During the listing duration, agents have the option to edit or remove videos.

Happy Homez will utilize third-party services like YouTube for hosting and streaming these videos. While doing so, the site and its users will adhere to YouTube Terms of Service (https://www.youtube.com/t/terms) and YouTube API Services - Developer Policies.

Use of information:

The user agrees to treat all information obtained from the service, including listings, the member directory, and any other information made available to the user (“Content”), as proprietary to Happy Homez. The user acknowledges that content reserved for members will be maintained as confidential and protected as a trade secret of Happy Homez. Happy Homez does not guarantee the accuracy, endorse, or recommend any content. Therefore, the user uses such content at their own risk.

The user may access listings and advertisements on the service solely to obtain initial information for further evaluation and investigation. The user should limit access to and use of listings to personal and internal purposes only. The user should not use listings obtained from the service for further distribution, publication, public display, or preparation of derivative works or facilitate any of these activities in any way.
Users shall not use or reproduce any Content obtained from the Service or made available to them in the Service for or in connection with any other listing or advertising Service or device. They shall also not use the Service provided by the company in any other manner for or in connection with any other listing Service or device. Users who violate these specific terms, particularly those who search the Service in an abusive or excessive manner, either automatically or manually, will be subject to immediate termination of their membership without notice.

Intellectual property rights:
All logos, brands, trademarks, and service marks (“Marks”) appearing on Happy Homez are the property either owned or used under license by R.S. and its associates. All rights accruing from these Marks, whether statutory or otherwise, are solely vested with R.S. and its associates. Therefore, access to Happy Homez does not grant users any license or right to use these Marks in any form or manner. Consequently, the use of these Marks in any way whatsoever is strictly prohibited. Any violation of these terms will constitute an offense under the prevailing laws of India.
R.S. respects the Intellectual Property Rights of all users and third parties. It will adhere to all applicable Indian laws in this regard. R.S. will protect and respect users’ and third parties’ Intellectual Property Rights to the best of its ability. If a user is found to be using Happy Homez to infringe others’ Intellectual Property Rights, R.S. can terminate this Agreement without notice.

By allowing users to access Happy Homez, R.S. grants users a limited, non-exclusive, non-assignable, revocable license (the “License”) to access and use the Services, provided that the user complies with the Agreement’s terms and conditions.

Restrictions/Prohibitions:

1.⁠ ⁠The following actions constitute misuse of Happy Homez and are strictly prohibited:

a. Using the Services offered by Happy Homez in a manner that impairs the interests and functioning of R.S. or Happy Homez and is not compliant with laws and regulations, including RERDA.

b. Copying, extracting, downloading, sharing, modifying, selling, storing, distributing, making derivative works from, or otherwise exploiting any content, data, information, including profiles, personal details, photographs, and/or graphics, available on Happy Homez or any services or products of R.S. in any manner or for any purpose that is not consistent with or in accordance with the Terms of Use.
Users are strictly prohibited from using or exploiting Happy Homez and its content or data for any commercial purposes, including creating alternate databases, extending access to Happy Homez to third parties without prior written consent from the R.S., engaging in business activities that compete with the R.S.’s, sharing access with individuals not contracted with the R.S., reselling the products or services offered by the R.S., or attempting to use any automated program, software, system, or similar process (including spiders, robots, crawlers, etc.) to access, navigate, search, copy, monitor, download, scrape, crawl, or otherwise extract any data or content from Happy Homez, including but not limited to adding or downloading profiles, contact details, or sending or redirecting messages. Additionally, users are prohibited from gaining unauthorized access to any portion or feature of Happy Homez or any of the services or products offered on or through Happy Homez that are not intended for them, including any server, website, program, or computer systems of the R.S. or any other third parties and/or users. Furthermore, users are strictly prohibited from modifying the services provided through Happy Homez or altering their appearance using any technology or overlaying additional offerings on top of such services, simulating Happy Homez’s services or functions in any manner whatsoever without obtaining explicit written consent from the R.S.. Users are also prohibited from accessing Happy Homez through interfaces other than those explicitly provided by the R.S. and are strictly forbidden from attempting to breach or breach any security or authentication measures set up by the R.S. in relation to Happy Homez, as well as probing, scanning, or testing the vulnerability of the R.S.’s system or network.
Scraping, downloading (including bulk-downloading), replicating, or otherwise extracting any information or data from Happy Homez (through any process, automatic or manual) to offer products or services similar to or potentially competing with those of the R.S. is strictly prohibited.

Additionally, reverse engineering, decompiling, disassembling, deciphering, or attempting to do any of the aforementioned actions to derive the source code for the Site, Application, or related technology is also prohibited.

Furthermore, circumventing or attempting to circumvent any technological protections employed by the R.S. or any third party to safeguard the content on Happy Homez and exclude robots, spiders, and other crawlers from accessing and scraping content is strictly prohibited.

Furthermore, bypassing or attempting to bypass any service limits, including search limits, Captcha limits, and occurrences triggered by specific actions, is also prohibited.

Interfering with or disrupting the use of Happy Homez or any computer networks connected to it by any other user is strictly prohibited.

Developing, using, or attempting to use any automated program, scripts, robots, third-party software, systems, or similar or equivalent processes (including spiders, robots, crawlers, browser plug-ins/extensions/add-ons, iframes on third-party sites, mirroring, HTML parsers, etc.) to access, navigate, search, copy, monitor, download, scrape, crawl, or otherwise extract or modify any data or content from Happy Homez without explicit written consent obtained by contacting us at legal@Happy Homez.com is strictly prohibited.

Impersonating another person or entity or making any misrepresentation about your employment or affiliation with any person or entity is strictly prohibited.

Forging headers or manipulating identifiers in any manner to disguise the origin of user information is strictly prohibited.

Stalking, threatening, or harassing any other user is strictly prohibited.
Imposing an unreasonable or disproportionately large load on Happy Homez’ infrastructure;

Engaging in “framing,” “mirroring,” or otherwise simulating the appearance or function of Happy Homez (or any part thereof) and providing deep links into Happy Homez (or any part thereof) without prior permission from R.S.;

Spamming Happy Homez/R.S. or any other Users by uploading, posting, emailing, SMS, transmitting, or otherwise making available either directly or indirectly, any unsolicited bulk e-mail or unsolicited commercial e-mail;

Hosting, modifying, uploading, posting, transmitting, publishing, or distributing any material or information that:

Violates any applicable local, provincial, state, national, or international law, statute, ordinance, rule, or regulation in force at the time;
Belongs to another person and to which you have no right;
Infringes, breaches, or otherwise contravenes the rights of R.S. or any third party, including any copyright, trademark, patent, rights of privacy or publicity, or any other proprietary rights;
Contains computer viruses, or other computer code, files, or programs designed to disrupt, destroy, interfere with, or limit the functioning of Happy Homez, or any other computer system or resource;
Is grossly harmful, harassing, invasive of another’s privacy, including bodily privacy, hateful, disparaging, relating to or encouraging money laundering or gambling in any manner, any content which is or may potentially be perceived as being harmful, threatening, abusive, harassing, based on gender, libelous, blasphemous, vulgar, pornographic, paedophilic, obscene, or racially, ethnically, promoting enmity between different groups on the grounds of religion or caste with the intent to incite violence or otherwise unlawful in any manner whatsoever;
Which constitutes or encourages conduct that would constitute a criminal offense, give rise to other liability, or otherwise violate applicable law.
That deceives or misleads the recipient about the origin of such messages or communicates any misinformation or information that is grossly offensive or menacing in nature;
That harms minors in any way;
That threatens India’s unity, integrity, defense, security, sovereignty, friendly relations with foreign states, public order, or incites the commission of any cognizable offense, prevents investigation of any offense, or is insulting to another nation.
You hereby expressly agree not to:
1.⁠ ⁠Copy and distribute this information on any other server or modify or reuse information, text, graphics, sound, etc., on Happy Homez on any other system. No reproduction of any part of Happy Homez may be sold or distributed for commercial gain, nor shall it be modified or incorporated into any other work, publication, or Happy Homez, whether in hard copy or electronic format, including posts to any other Happy Homez; or
2.⁠ ⁠Remove any copyright, trademark, or other intellectual property notices from any material copied or printed from Happy Homez or link to Happy Homez without our explicit written consent. 
3.⁠ ⁠Violations of the system or network security may result in civil or criminal liability.

Links to third-party websites
Happy Homez may provide links to other third-party World Wide Web sites or resources. R.S. makes no representations whatsoever about any other Web site you may access through Happy Homez.

Disclaimer and warranties
Happy Homez is an intermediary as defined under sub-clause (w) of Section 2 of the Information Technology Act, 2000.
THE CONTENT OF Happy Homez IS PROVIDED “AS IS” AND ON AN “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OR REPRESENTATIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED.
R.S. and any third party providing materials, services, or content to this website disclaim all warranties, express or implied, statutory or otherwise, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement of third party rights, completeness or accuracy of the information, updates or corrections of the information, freedom from computer viruses, or other violations of rights regarding services, products, materials, or content on Happy Homez.

The views expressed by users are their own and do not represent the views of R.S.. R.S. does not endorse any user-generated content and shall not be responsible for any user-generated content. No claim is made about the accuracy and correctness of the information on the site, although every effort is made to ensure that the content is not misleading, offensive, or inappropriate. If any inaccuracy or otherwise improper content is found on the website, please report it to report abuse.

It is solely your responsibility to evaluate the accuracy, completeness, and usefulness of all opinions, advice, services, real estate, and other related information listed on the website. R.S. does not warrant that the website will be uninterrupted, error-free, or that defects in the website will be corrected.

R.S. offers no guarantees or warranties that there will be a satisfactory response or any response at all once a listing or banner is displayed. Any payments made to R.S. or Happy Homez are solely for the purpose of displaying the property advertised.

Users are strongly advised to independently verify the authenticity of any pre-launch offers received by them. R.S. does not endorse investments in any projects that have not received official sanction and have not been launched by the builder or promoter. Users dealing in such projects shall do so entirely at their own risk and responsibility.
No information provided on Happy Homez constitutes an invitation or an offer to invest in R.S. or any of its affiliates. Additionally, nothing on Happy Homez should be interpreted as a recommendation to use any product, process, equipment, or formulation that conflicts with any patent. R.S. makes no representation or warranty, express or implied, that the use of such products or processes will not infringe any patent or otherwise.

Happy Homez is operated and controlled from India, and R.S. does not guarantee that the materials available on Happy Homez will be appropriate or accessible in other parts of the world. If you use Happy Homez from outside India, you are solely responsible for complying with all applicable local laws, international conventions, and treaties.

R.S. offers products, services, content, and various functionalities through Happy Homez and its affiliate sites in specific regions worldwide. The services available in one region may differ from those in others due to factors such as availability, local or regional laws, legal impediments, and other considerations. R.S. does not make any warranty or representation that a user in one region will be able to obtain the services as provided in another region.

Information on Happy Homez may include references to products, programs, or services that are not currently announced or available in your country. These references do not imply that R.S. intends to announce, launch, or provide such products, programs, or services in your country.

Limitation of Liability:

R.S. does not assume any liability for any damages, losses, or expenses incurred by users in connection with the use of Happy Homez or its content.
R.S. will not be liable for any damages, including but not limited to errors, omissions, interruptions, defects, delays, computer viruses, line failures, and other direct, indirect, special, incidental, punitive, loss of profit, exemplary, or consequential damages, whether based on warranty, contract, tort, or any other legal theory, including Force Majeure. This includes damages that may arise even if R.S. was intimated or advised of the possibility of such damages.

R.S. also assumes no responsibility for any errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication line failures, theft, destruction, unauthorized access to, or alterations of User’s data/information. R.S. shall not be responsible for any problems or technical malfunctions on online systems, servers, providers, computer equipment, software, failures of email or players due to technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to any User, Members, or other person’s computer related to or resulting from participating or downloading materials/information from the website.

For the purposes of the Consumer Protection Act, 2019 (CPA), the term “Consumer” will be limited to paid Customers who have not subscribed to Happy Homez for commercial gain (business purposes) and whose intent is to utilize the services solely for individual use.
Unless otherwise specified and notwithstanding any other agreement or arrangement, the service provider, R.S., is obligated to provide access to its online portal to the customer for the duration of the subscription period. Additionally, if any other performance obligation exists, reference to any usage, by any name, is to provide the upper limit for consumption. This upper limit alone does not create any additional performance obligation for R.S..

R.S. will not be held liable for any inaccuracies in information on this website. Any breach of privacy or the unauthorized use of information provided by the consumer to R.S. for placement on the website by technical or any other means is not the responsibility of R.S.. R.S. does not guarantee the confidentiality of information provided to it by any person acquiring or using all or any information displayed on Happy Homez website or any of its other websites or domains owned and operated by R.S..

Termination: R.S. may, at any time and without notice, terminate or restrict your use or access to Happy Homez (or any part thereof) for any reason, including, without limitation, that R.S. believes you have violated or acted inconsistently with the terms and conditions of these agreements or any applicable law.

Indemnification: Submissions and unauthorized use of any information (s)/materials contained on Happy Homez may violate copyright laws, trademark laws, privacy and publicity laws, certain communications statutes and regulations, and other applicable laws, statutes, and regulations. You alone are responsible for your actions or the actions of any person using your username and/or password.
You agree to defend, indemnify, and hold harmless R.S. and/or its associates, subsidiaries, officers, directors, employees, affiliates, licensees, business partners, and agents from and against any claims, actions, or demands, including without limitation reasonable legal and accounting fees, arising from your use of Happy Homez material or your breach of these terms and conditions or any applicable law.

R.S. will not be a party to any legal proceedings between parties contracted through these Services. If R.S. is implicated in any legal proceedings, costs will be recovered from the party that names R.S. as a party to such proceedings. R.S. will comply with any court order served on it through due process.

Privacy Policy
The Privacy Policy of the Platform explains how we may use your personal data. We will always respect and ensure adherence to the Privacy Policy. Additionally, various settings are provided to help you control how others may view your information, as chosen by you to be displayed on your profile, and how you may choose to be contacted. Any feedback provided by a User will be deemed non-confidential to the User.

Terms of Use for Users

When you express interest in a Real Estate Listing or related services on Happy Homez, you grant Happy Homez permission to contact you, even if you’ve registered with the National Do Not Call Registry (NDNC) or the Do Not Call Registry (DNC). You’re also sending your profile, which includes your personal details and application information, along with relevant documents, to Happy Homez. Additionally, you’re requesting and authorizing Happy Homez to share this information with the applicable Advertiser/seller(s) for the Real Estate Listing(s). By doing so, you’re consenting to your data being provided to these Advertisers/service providers and others, who may further contact you via phone, email, WhatsApp, or other means.

Please note that our privacy policy doesn’t apply to the use of your data by third parties once it’s shared.

In addition, by using Happy Homez, you acknowledge that Happy Homez is not responsible for the content of the Advertiser/seller’s/broker’s/builder’s application form, messages, screener questions, testing assessments, required documents, or their format or method of delivery.

You consent to Happy Homez processing and analyzing your application, documents, and any responses sent to you by the Advertiser/seller or vice versa through Happy Homez, as outlined in these terms of use and Happy Homez’s privacy policy. Happy Homez will store and process this information regardless of whether the advertised Real Estate remains available or not. Happy Homez may use your application materials (including your public profile with personal details and responses to advertiser/seller questions) to determine if you’re interested in a Real Estate Listing. They may also contact you via calls, SMS, emails, or other means about such Real Estate Listing or other similar properties. (Note that you may have registered with the National Preference Register (NCPR).)
Information you share in public areas of Happy Homez sites, applications, or make visible in your profile may be accessible, used, and stored by others worldwide, including those in countries without adequate protection for personal information as defined by your country of residence. While Happy Homez takes measures to safeguard your information, we don’t control these third parties and are not responsible for their use of the information you provide. Therefore, avoid posting sensitive information or anything you wouldn’t want made public to any part of Happy Homez, its application, or a public website.

Additionally, it’s solely your responsibility to ensure that you use the ‘Opt-out’ options as you see fit to prevent dealers from accessing your data. Ramdee Solutions won’t be held responsible for any insertions or data being accessed by its subscribers or users whose access hasn’t been specifically blocked or deared by the user while using the privacy settings.

To use Happy Homez, you can sign in using your Facebook or Google login. By doing so, you authorize us to access and use certain Facebook or Google account information, including your public Facebook profile and posts. Terms of conditions specific to dealers, builders, banks, and payment gateways.

You’ll comply with all applicable Data Protection Laws in processing personal data and won’t process irrelevant data in an unlawful or excessive manner, as defined in the privacy policy and these terms and conditions.
You’ll implement robust technical and organizational controls to safeguard the shared personal data acquired from Happy Homez against unauthorized or unlawful processing, accidental loss, destruction, damage, alteration, or disclosure.

You agree to provide reasonable assistance to facilitate the handling of any Data Security Breach (as applicable to the privacy law) in an expedient and compliant manner.

You acknowledge that the responsibility for complying with an individual’s request regarding their personal data lies with the entity that holds or processes the data.

You warrant and represent that the institution will not disclose or transfer Personal Data obtained from Happy Homez to any sub-processors without ensuring that adequate and equivalent safeguards are in place for the Personal Data.

You shall retain or process shared personal data for no longer than is necessary to fulfill the agreed-upon purposes.

Arbitration:
In the event of any dispute between a user or users and R.S. arising from the use of the website or thereafter, concerning the validity, interpretation, implementation, or alleged breach of any provision of these terms and conditions, the dispute shall be referred to a sole Arbitrator, an independent and neutral third party. The Arbitrator’s decision shall be final and binding on both parties to the dispute. The arbitration venue shall be Delhi. The Arbitration & Conciliation Act, 1996, shall govern the arbitration proceedings.

Severability of Provisions:
This Agreement between you and R.S. governs your use of Happy Homez. If any provision of these Happy Homez terms and conditions or a part thereof is inconsistent with or deemed invalid/void by any law, rule, order, or regulation of any Government entity or by the final judgment of any court, such inconsistency or invalidity shall not affect the enforceability of any other provision of the terms and conditions.

Waiver:
The failure of R.S. to exercise or enforce any right or provision of the terms and conditions of use shall not constitute a waiver of its right to do so in the future.

The governing law applicable to all matters relating to Happy Homez and these terms and conditions is the law prevailing in India.

The exclusive jurisdiction in all matters relating to Happy Homez and these terms and conditions lies with the courts in New Delhi, India, regardless of the territory or jurisdiction of your access to Happy Homez.

R.S. does not routinely monitor your postings on the website but reserves the right to do so. However, if R.S. becomes aware of any inappropriate use of Happy Homez or any of its Services, R.S. will respond in any manner that, in its sole discretion, R.S. deems appropriate. You acknowledge that R.S. has the right to report any actions that may be considered illegal, as well as any information it receives about such illegal conduct. When requested, R.S. will cooperate fully with law enforcement agencies in any investigation of alleged illegal activity on the Internet.

R.S. reserves all other rights.
